So in my day job at a print shop, we came across this girl that is making these tshirt orders independently for bands, selling them on Etsy and making 100% profit. She has 27 separate orders.

I think shes an asshole, personally. Granted, the One Direction shirt does say "Enthusiasts", I really don't think she knows she's stealing from these bands.

Also, I know from talking to the sales people here who deal with her, she's selling out and making a lot of money off of these band's names.

*Also, knowing the owners here, they will not and probably do not give a fuck about licensing. Trust me.

    Technically, I would consider it stealing because she is unofficially using an artists name or company name for 100% individual profit, but tons of small shops and shit do it. For example shops you see on the boardwalk printing non-licensed tees, those people who sell t-shirts in the lots at concerts and sporting events.

    On the other hand, she isn't using any official logo designs, or licensed images...so who knows in this case. It clearly doesn't feel right, and if it doesn't feel right I'd say it's wrong...but I'm no lawyer.

    I used to work at a print shop for a bit back when Phillies were in the World Series and we had this guy come in every week with designs for me to prep for printing...they were knockoff Phillies t-shirts that he sold at the stadium and bars. I hated that guy.

    I have had a huge part in 5SOS merchandise since July so I'll send it to my contact there and get her shut down and sued haha! these people need stopping or a lot of us will be having pay cuts when the industry gets hit

    I was hoping someone with some connections to them would see this, I'm not sure if its a legal issue, but I feel bad for the band since these days merch makes up a lot of band's incomes

    I've E-mailed their rep... they don't take this stuff lightly! A band like 5SOS make an absolute fortune in merchandise so naturally they won't want anyone damaging that

    But not officially using a bands name is stealing. Hell even cafepress knows to go generic with song titles or lyrics...

    I'm glad you guys weren't around back in 95 while i was printing bootleg minor threat and op ivy tees for my friends and i. Ebay and Etsy also weren't around. If she really is just 17 or so, she needs some C&D's and I'm sure it'll teach her whats up. At least she's got initiative! The ones that don't say the name of the band printed on the tee don't bother me personally so much, but I'm also the guy getting original art inspired by books I didn't write.

    Also she's used loads of their official branding. I recognise a tonne of the imagery from their brand guide like the guitar and arrow doodles... their rep told me they are on the case so she's about to learn all about C&D letters at a young age (if she's lucky to get off that lightly)

    My guess would be the owners never sent Etsy a DMCA takedown. If they had, the stuff would have been removed immediately.

    Wow this is insane. Over 3,000 sales? I'd love to have 3,000 sales this year.

    For me, this what makes me mad, not just that she's stealing- but that it's unoriginal. I spend a lot of time trying to create original and unique things for my brand and a lot of haaarrrd work getting it out there for people to see, and then eventually building a relationship with the person where they make a purchase.

    She's just riding the coattails of someone else's accomplishment and ideas. We all do that to an extent because inspiration has to come from somewhere, but this is just stealing.

    Some days I think I should be making Belieber or GO GOMEZ garbage because it wouldn't take long to design and it would make a killing on sales.

    Honestly try not to waste your time thinking about what other people are up to. There are a lot of people out there that are happy to make a quick buck doing work that isn't original in any way, but the success that they find doing that sort of thing tends to be short lived in terms of really making a lasting career out of it. Just keep doing you. =D
