looks like both took reference from the same photo and that's it... yeah, a book author holding a book and tentacles behind that's it. I can see why the other guy thinks it's a rip, but it's probably just coincidence.,,
  • Rico

I highly doubt he'd rip, he's a well respected artist, he's not stupid, and he's been around enough here to know the whole ripping struggle thing.
  • Patrick

"both designs use the same source: a rather iconic photograph of Lovecraft. then they add Cthulu. Why exactly this? because Cthulu is iconic Lovecraft's iconic creation. There's your design ... it's not very creative (neither is) but it looks dope. end of the story."

    This.
  • walline

Whether he based his design on the Francavilla design or whether it was just a case of convergent inspiration (which totally happens), Jimmy does not seem to be doing a good job of cultivating a sense of authenticity by basically saying to sell yourself better or STFU about being ripped.

    Shrug.
  • Craig Robson

its like the entire lovecraft franchise. its him+tentacles. nuff said?
  • Jupit

"Screw other people's opinion about whether you ripped an idea or not. They don't know what's in your heart, and even then, art is a business, it's competitive, and barring any infractions of actual executable law, all is fair in love, art, and war."
dang, Jimiyo sounds like Shepard Fairey...
  • gaunty

How come I've never had this idea before?
  • dobi

what craig said, looks like coincidence + same reference photo used.
  • Jupit

hm, but what would you do if you see an image that's been used plenty of times as reference or similar. do you say "fuck it, it's been done to death", or "fuck it, I still have to make a design based on this"?
  • RustyEight

I highly doubt that Jimiyo would stoop that low.
  • cityhall

This is just fucking dumb. I might have thought it was a rip if I never saw that picture of Lovecraft.
  • _starryeyez_

He's such a great artist btw.

    This
  • Anthony Smith

Unfortunate coincidence, although I cant help but feel Jimmy could have approached the situation more sympathetically.
  • D3

I don't know if jimiyo actually saw the work that Francavilla made, but he didn't add anything new and there is a lot of coincidences.
In this case I'm going to stay neutral. Although I like jimiyo's works a lot, i simply hate it when someone uses a character or something pop-culture related just to win the crowds vote because they can relate to darth vader better than they can relate to a more artistic shirt. Also, jimiyo's approach to Francavilla was far from sympathetic and unprofessional.
  • TenTimesKarma

just saw this on jimiyo's website
  • DanielAndHisArt

That Francavilla dude is fucking heartbroken.

He is freaking out on twitter.
  • wotto

If it was me I'd either give the profits to charity or halve it with the artist, case closed and everyone can move on.
  • Matt Borchert

We all know Jimiyo is hurtin' for the money enough to rip some random dude for an HP lovecraft shirt....yeah.....that's totally his way of workin' the biz.

Jimiyo should counter sue for libel...just for fun.
  • atomicchild

now they are saying he just traces photos.....here is an example they listed

  • RustyEight

    Wish he would chime in.
  • TenTimesKarma

so far his only response is this :
    http://twitpic.com/6qxxoq
  • atomicchild

yeah this is def not a rip at all....same idea and that is it
  • lazyeye

Looks like Francesco Francavilla has his own manticore team fired up. I think the left eyeball element was borrowed tho.
  • RoboPickle

People are getting ridiculously into this. It's similar but not an exact copy.
  • mj00

I understand the left eye argument, but I don't think it holds water when you look at the rest of Jimi's work. He does the "one weird eye" thing fairly often (quick redbubble grab, but I seem to remember others that weren't on RB):

    http://www.redbubble.com/people/jimiyo/t-shirts/6471131-the-fairest-of-them-all
    http://www.redbubble.com/people/jimiyo/t-shirts/5231085-dead-mans-chest-ii

And on top of that, we know he's into cthlulhu eyes in general from his past work, too:

    http://jimiyo.com/2011/05/31/free-wallpaper-porthole-cthulhu-kraken-octopus-thiny/
    http://shirt.woot.com/Derby/Entry.aspx?id=9826
(and even a zipper pull- )

It's a bummer that the designs are similar, but it's equally a bummer that people are so quick to make assumptions without doing their own critical thinking. There are more differences than similarities, it's just that the similarities (particularly the Lovecraft portrait) are some of the most obvious things about the design :/
  • 8-bit ZOMBIE

Yeah, I too think this is just a case of coincidence. Not sure how Francavilla doesn't know that the internet is chock full of H.P. portraits that involve tentacles and/or books. If Jimiyo is guilty of being a copycat, so is he.....
  • CASTLE

Being a huge fan of Francesco's work, I immediately recognized the influence when I saw jimiyo's design on OMG posters. Maybe the FF design was subconsciously imprinted in Jimiyo's brain having come across it before but not actually realizing where the thought had come from. Like subconscious inception.

I've been afraid this would happen to me at some point... its bound to happen when consuming mass amounts of design and artwork. You organize all these thoughts and inspirations in your head, you're not gonna remember where all your ideas have come from.

Although it is basiclly the same composition, its definitely different. Jimiyo has built enough of a reputation with me where I'm not going on a witch hunt. I have to much respect for him.
  • miles to go

the problem with these pop culture websites is that it promotes quick designs to sell fast regardless of their influence because they only sell for 24hrs. even if its a rip or uses copyrighted characters without proper permission, it slips by because its gone so quickly. he is a good artist, but this design even looks rushed whether it was borrowed/influenced or not.
  • mrdavenport

Jimiyo has been a huge inspiration and help to me. When I was first starting out I would email him questions and he would take time to respond to each one. Im a huge fan and its sad that this amazing artist is receiving such hate. Haters gonna hate!

    Long live Jimiyo.
  • mrdavenport

    btw, Adam Sandler?

  • SKUMMIE

Looks like they are both guilty of being unoriginal, that's about it.
  • Andrew Haines

Some of the people leaving those comments are not doing their homework and seem to be bandwagon-ing pretty hard.

Lovecraft is known for Cthulhu(his quintessential cosmic horror work) more than anything else, so why is it such a big deal when someone does a portrait of Lovecraft and his biggest sci-fi influence that he's given to the world? Next I'm gonna see bitching that Mike Mignola is ripping this guy because he's done plenty of Lovecraftian artwork throughout Hellboy, specifically his Ogdru Jahad which has been shown wrapped around Rasputin(who has an eerily similar look to a bald Lovecraft) in the series. Francavilla started to team up with Mignola further down the road, but Mignola was doing this before Francavilla starter to pen Hellboy work.

Or something like this that Mignola has done time and time again:

I'm not Jimiyo's biggest fan, but if a simple google search turns up that many DIFFERENT pieces of art depicting the exact same thing, I don't think you have a leg to stand on as far as being the "originator" of the concept. On that note, and I could be mistaken, but for some reason I remember seeing an actual photo of Lovecraft with a Cthulhu monster adorning the background behind him.

scanning [...] rip not found [...] please try again
  • Integral

I think Jimiyo is an amazing artists, but I have always said he traces some things.
I just think if its a "crappy artist" people would kill em, but if you got weight around here or the interwebz people will back you forever.

For example - in an illustration thread years ago Jeff B. traced some octopus via google and people ripped him to shreds. Jimiyo does the same thing makes LOTS of money off of it and nothing.. #justsayin

You might want to check the outcome of that lawsuit. Also, HELLO PARADY LAW!
  • jumpy

i think all of these Shepard Fairly parodies run that risk, but hardly worth the time and $$$ involved http://www.ap.org/iprights/fairey.html

That Hurley piece so easily falls under Parody law that it just isn't even worth the time to think about the legalities..Jimiyo knows it...
