long story short, 21 year old kid performs some songs at a school for 7 year olds, films everything, things go over well. goes back to school when kids are gone, records a dirty song in the same room.

edits video to make it look like he was singing the raunchy song in front of the kids. the students never heard the raunchy song, they heard "the lunchlady song" and "splish splash"

after putting the edited video on youtube, he has been arrested and is charged with a felony, faces 20 years in jail and being put on the sex offender registry.

    i can see why it's happening, what with the stigma around children and pornography. he's making it appear like he's singing sexually explicit lyrics to children. ok, so he isn't actually doing that but it's more or less the same thing as digitally manipulated photos depicting scenes of a sexual nature. i'm sure somewhere out there, there is a pervert that would get off to that song video which is why evan is facing legal action.

    this one guy i read about from the UK... he's being prosecuted for creating animal porn but it isn't real... just digitally altered pictures of people with animals in a sexual nature. the courts don't see it as anything but illegal pornography regardless of whether abuse occurred or not.

    obviously evan was doing it for a joke, but not everyone will see it that way.

It would be his life ruined over something so stupid. Fact is the kids never saw it, there were disclaimers. The only thing he should have done would be blur out the child's faces, but that's it.     As far as the "manufacturing of child sexual abusive material" no i do not think he should be charged.
    But as far as him being deceitful in his intentions from the start and the parents not agreeing to their children being recorded, yes i can see how they have a case.
